Registration of a company as an employment agency

There are a few requirements for the registration of a company as an employment agency or any activity that comes to mediaing between employees and employers.

In brief – if it is a company registered in Bulgaria (our case) the requirements are related to the personnel - employees must be with a minimum High School education, and the employees and managers must not have debts to the Bulgarian tax authority of any kind, must not have any disciplinary actions taken agains them as CEO or managers of previous companies, must not be managers or member of the boards in certain types of companies (better not any) and there must not be any actions taken against them for any type of disciplinary or other offence.

The activity must be specified in terms of locations and type - more detailed information.

Some documents are needed, the list here is not comprehensive, just pointing the most important things:

1. A copy of the registration;

2. Notarized copies of documents completed secondary or higher education of the individual or representative of a legal person under Art. 3 and of employees who will perform intermediary activity on employment;

3. Notarized copies of documents confirming the existence of seniority not less than three years in the field of maritime transport of natural person or representative of the legal person under Art. 3 and of employees who will perform intermediary activity on employment of seamen;

4. Documents certifying the circumstances under Art. 27a para. 1, p. 1-3 of the Law on Employment Promotion, according to the laws of the State of registration - if registered as an agency in another country - I will explain further if required;

5. The unique identification number for registration under Art. 10, para. 1 pt. 2 of the Law on protection of personal data kept by the Data Protection;

6. A list of individuals hired to perform intermediary activity on employment in the Republic of Bulgaria containing data for completed secondary or higher education;

7. A list of individuals hired to perform intermediary activity on employing seamen in the Republic of Bulgaria containing evidence of work experience not less than 3 years in the field of maritime transport;

8. If the manager is a citizen of another country he/she must sign a declaration or an affidavit about these requirements and in some cases might be required to present an evidence from the country he is a citizen of and a country he permanently lives in (for example debts to the tax authorities).
